Please read this document carefully as the guidelines set forth will be strictly enforced. Hudson House Program Guidelines-050126 .pdf Download PDF • 165KB Complex and Amenities The Hudson House consists of 36 one and two bedroom age-restricted apartments and is located at 104 Front Street, Mineola NY. All of the units are required to be maintained as income restricted age restricted rental units. Age Restricted Occupancy Requirement Occupancy of a unit shall be for residential purposes and shall be limited to persons who are 55 years of age or over, with the following exceptions: A) A husband and wife under the age of 55 years who is residing with his or her spouse who is 55 years of age or over. B) Children and grandchildren residing with their parents or grandparents where one of said parents or grandparents with whom the child or children or grandchild or grandchildren is/are residing is 55 years of age or older, provided that said child or children or grandchild or grandchildren are over the age of 19 years. Proof of age (license, i.d. card, etc.) is required. Income and Rent Restrictions In accordance with the requirements of the Village of Mineola, units will be leased to households with incomes at or below 80% of the HUD Area Median Income for Nassau/Suffolk County, adjusted for family size. Approved rental assistance subsidy will be counted toward minimum income. Income requirements shall be adjusted annually based on HUD Published Area Median Income for Nassau/Suffolk County. Minimum Income Guidelines do not apply to those applicants with an approved rental subsidy. *Not including any mandatory or optional charges for other services *Rents are updated annually. Tenants are responsible to pay all utilities, including electric and gas. Affordability Period The affordability restrictions stated above will remain in effect in perpetuity at the discretion of the Village of Mineola. Annual Income Recertification. Tenants will be recertified annually in accordance with the income and rent guidelines established above based on the HUD Area Median Income in effect for each year. Leases will contain addendums that outline the requirements for continued eligibility and requirements to recertify annually. Tenant Selection Procedures Step One - Submission of Wait List Application Applications will be processed on a first come, first serve basis and may only be submitted online. Mailed or hand delivered applications will not be accepted. Applications will be accepted via CDLI’s website at www.cdli.org . Applicants will be placed on a wait list in the order in which their application is received. Applications will be automatically dated and time stamped for submission and included in a database. Applicants will be notified of their waitlist rank number by CDLI. CDLI will contact applicants in ranked order to determine formal eligibility for a unit. Step Two - Preliminary Eligibility Review As applicant’s names are reached on the Waitlist, CDCLI will contact applicants in ranked order, by email, if available, or by phone. If an applicant remains interested, the applicant will be asked to submit a Formal Rental Application, together with required documentation that will include Proof of age for all household members* last 2 years of federal income tax returns, W-2 and/or 1099 form; four most recent consecutive pay stubs; three most recent consecutive monthly bank statements for all bank accounts and investment accounts. *The following documents are considered to be reliable for age verification: birth certificate, driver’s license, passport, immigration card, military identification, or any other state, local, national or international documentation, provided it contains current information about the age or birth of the possessor. The applicant will have 5 business days to provide the fully completed Formal Rental Application together with all supporting documentation. If the foregoing is not received by CDLI within such time period, the applicant will be ineligible and a letter will be sent confirming same. The applicant will also be required to provide certain consents in order to permit CDLI to verify income submissions and employment, and to permit the Owner/Manager to conduct background checks, credit checks and criminal background checks. The applicant will be required to submit a one-time fee of $20 per person with the Formal Rental Application to cover the cost of credit and background checks. Income will include all gross income, including, but not limited to, income from full and part time employment, overtime, bonuses, tips, pensions, social security, 401k and IRA distributions, child support, alimony, and severance pay. ALL sources of income are included and will be annualized for the upcoming 12-month period. Total income minus allowable exclusions, if any, cannot exceed the maximum income limits. Once a full review of the Formal Rental Application has been completed, the applicant will be notified by email, if available, or by regular mail of their status. If the applicant is deemed eligible, their application will be forwarded to the Owner/Manager for final review and assessment pursuant to Step 3 below. If an applicant is deemed ineligible, they will be advised of the reason and be allowed 5 business days to address or correct the deficiency. If received in a timely manner, the information will be reviewed by CDLI and the applicant advised of eligibility or ineligibility by email, if available, or by regular mail. If determined to be ineligible, no further review will be conducted. The process set forth in Step 2 will continue until applicants for all 3 of the affordable units have executed a Lease Agreement with the Owner/Manager as described in Step 3 below. Step Three - Tenant Suitability Screening The third step in the process is for the Owner/Manager to conduct a final eligibility review for those applicants deemed preliminarily eligible pursuant to Step 2 above. As applicants are deemed eligible pursuant to Step 2 above, the applicant’s information will be forwarded by CDLI to the Owner/Manager who will conduct the suitability screening review. This will involve assessing the applicant’s suitability for tenancy through employment verification, leasing history, creditworthiness, and criminal background checks utilizing a reputable company and adhering to the Fair Credit Reporting Act. Applicants will also be required to show that they are able to provide first month’s rent and a security deposit. Applicants who are successfully screened will be offered the opportunity to enter into a written Lease Agreement. The process above will be repeated until three fully eligible applicants are identified and enter into a Lease Agreement with the Owner/Manager. Commitment to Fair Housing & Nondiscrimination The Owner/Manager is fully committed to enforcing the spirit and the letter of Title VIII of the Civil Rights Act of 1968 (Federal Fair Housing Law), the Fair Housing Amendments Act of 1988, the Americans with Disabilities Act, the New York Human Rights Act, and the Suffolk County Human Rights Act. Neither the Owner/Manager nor any of its affiliates, employees, agents, or brokers will discriminate in the sale, lease, advertisement or financing of housing against any individual or family because of race, color, national origin, religion, gender, disability, gender identity, marital status, sexual orientation, veteran/military status, source of income, or on the basis of any other protected class except familial status in accordance with HOPA exemption for housing for older persons. It’s an interest-bearing account established by New York State on behalf of the FSS family where deposits are made throughout the duration of the family’s participation in the FSS program if and when their rent increases as a result of increased earned income by anyone in the FSS family. If the participant who signed the Contract of Participation (“Head of FSS family”) successfully completes the program, they are provided with the money saved. If they meet good standing guidelines, the Head of FSS family can request up to half of what they have earned in escrow at any point during their program participation to support needs related to their Service Plan goals. Completing the Contract of Participation The FSS Contract requires that the family comply with the lease. NEW as of August 2022: All FSS family members (not just the Head of FSS family who elected to participate in FSS and signed the Contract) are welfare-free at the time the FSS contract is completed, and that the Head of the FSS family seek and maintain suitable employment. You must have suitable employment in place by your Contract end date to graduate from FSS and receive any escrow you have accrued. The family successfully completes the FSS Program when it fulfills all its obligations under the Contract of Participation on or before the expiration of the contract term. The FSS program helped me maintain a positive outlook on life and continue to make goals as well as accomplish them. It is a strong support system that helped me overcome many issues on my way to self-sufficiency. These units help address the shortage of affordable housing in many of the Town of Southampton’s hamlets. Note: In the Town of Southampton’s local code, ADUs are referred to as “Accessory Apartments.” ADUs provide an additional option for housing that is typically more affordable than renting or buying a standalone unit. These classes are led by HUD-Certified Housing Counselors and are designed to prepare first-time homebuyers with the knowledge and tools they need to navigate the homebuying process with confidence. The Orientation is an informational session regarding our services with the focus on Homebuyer Education. Although there isn’t any certificate provided to you upon completion of the Orientation, it gives you the opportunity to enroll in our Homebuyer Education Program. You will receive a Certificate of Homebuyer Education upon completion of the 8 hour class and one to one appointment with your Housing Educator. What is the "one to one" appointment? Upon completion of the homebuyer education class, you’ll schedule an appointment to meet with one of CDLI’s knowledgeable Housing Educators to discuss your individual housing goals. This is for your benefit! Ask lots of questions so the Housing Educator can assist you accordingly. During this appointment, the Housing Educator will review your income, assets, credit and budget. They’ll discuss various mortgage programs and grants that may apply to your current housing goals. The Housing Educator will provide you with guidance and resources to assist you as you navigate the homebuying process. At the end of the appointment, you will be provided a detailed action plan with your next steps, a summary of your budget and the homebuyer education certificate. The Housing Educator will follow up with you monthly to see how you’re progressing towards homeownership. How long is the homebuyer education certificate good for? Your homebuyer education certificate is good for one year after the date of your one to one appointment. Is there a fee for the Homebuyer Education? Yes. The class is offered in person or virtually and the fees vary depending on how you take the class. Our in person class is $50.00. We also offer our class via zoom and the fee is the same. There are also two options for you to take the class online. With the online options, you can complete the 8 hour class at your leisure. The online options are either $75.00 or $100.00. What is covered in the Homebuyer Education Class? The class covers what you need to know from the pre-approval to closing and everything in between. Renting vs. buying, budgeting, credit. You’ll learn about the role of a loan officer, realtor, home inspector, homeowner’s insurance agent, and closing attorney. Also covered is emergency preparedness and post closing resources. If you choose our in person class, we have professionals in the field discuss their role. How do grants work? Grants are based on household income, household size and availability. Homebuyer education is typically a pre-requisite just to apply. Most grants must be awarded to you prior to signing contract on a home. They typically cover various regions/areas of Long Island. For example, there may be a grant that covers Nassau County and one that covers Suffolk County. Keep in mind that you should be “homebuyer ready” prior to applying for a grant, meaning that you have a pre-approval. Remember, a grant may cover some of the down payment and closing costs so you’ll need a pre-approval to cover difference. Are grants just for down payment? In addition to grants for down payment, some cover home repairs/renovations. Do I have to repay any grants that I receive? Typically, grants have a “recapture clause", meaning that as you remain in the home, the grant is forgiven over time. For example, if a grant has a 10 year recapture clause, a portion of the grant is forgiven over time. If you sell the house or refinance the mortgage prior to the recapture clause expiring, you may have to pay back some or all of the grant funds received. How do I know which lender to choose for a pre-approval? During your one to one homebuyer education appointment, you will tell your Housing Educator what’s most important. For example, a low interest rate, down payment assistance, or even a lender who caters to borrowers with a lower credit score. Based on what you tell us and our assessment of your mortgage readiness, your Housing Educator will provide you with at least 3 referrals to lenders. You are under no obligation to use them. However, keep in mind that CDLI screens the services of mortgage lenders throughout the year to see who offers the most incentives for 1st time homebuyers. Those are the ones that we have on our list. I'm disabled. Can I purchase a home? Purchasing a home is based on your ability to pay. It’s not based on the source of your income, it’s based on the amount of your income. As long as your income is documented and consistent, in most cases, it can be used to qualify for a mortgage. We say in most cases because ultimately, you’ll have to meet with a mortgage loan officer who will submit your loan application to underwriting. How much money do I need in savings to purchase a home? Typically, you’ll need 3% of the purchase price for down payment and an additional 5% of the purchase price for closing costs. How much income do I need in savings to purchase a home? This depends on other factors, such as the purchase price, down payment, property taxes, homeowner’s insurance, etc. You should also take into consideration how much outstanding debt you owe. For example, if two borrowers have identical income and savings but one borrower has no debt and the other has a car payment, student loans and credit cards, the borrower with the debt will qualify for a lower mortgage amount.
